Tillman County Sheriff Bobby Whittington said the suspect was taken into custody at the department after investigators interviewed him about the rape of a 9-year-old-boy.
Whittington said Bernal was staying with the victim's family at a residence in Davidson. He was reportedly a friend or relative of the male parent living there.
Whittington said last Monday night or early Tuesday morning, Bernal came into the boy's bedroom and committed the act.
The victim went to school the next morning, but as soon as he came home from school Tuesday, Whittington stated the boy told his mother what happened.
"He (the boy) wanted to wait until the man wasn't there to tell mom what happened-to give him a chance to speak to her alone," Whittington said.
According to Sheriff Whittington, Bernal was charged with one count of first degree rape, if convicted he could face up to life imprisionment, his bond has been set at $100,000
